An Analysis of Safe Harbor Laws for Minor Victims of Commercial Sexual Exploitation: Implications for Pennsylvania and Other States

Abstract

This paper examines challenges and lessons learned from Safe Harbor laws across the United States, with recommendations for Pennsylvania and other states that have not yet passed Safe Harbor legislation. As of 2015, two-thirds of the states had enacted some form of Safe Harbor legislation. These laws move away from a prosecutorial to a victim-services approach for child sex trafficking victims. Safe Harbor laws aim to offer and engage victims in rehabilitative services instead of charging them with a crime. To inform recommendations for future legislation and program development for victims of sex trafficking, the authors analyzed the research on victim compliance with specialized services, utilization of child welfare systems in lieu of juvenile justice systems, and approaches to gain compliance with the prosecution of traffickers. This research supports engaging victims of sex trafficking in voluntary trauma-informed specialized services to promote healing, encourage service compliance, and develop trust so they will assist in the identification and prosecution of sex traffickers. It was also found that involuntary detention replicated the trauma experienced by sexually trafficked youth, prevented their recovery, and increased the likelihood of recidivism. To develop specialized services as an alternative to prosecution, the authors suggest implementing new Safe Harbor legislation within six months after its passage. (author abstract modified)
